SC Business Insurance Claims, Disputes, and Denials

South Carolina Dispute Attorney

When an insurance company fails to pay a legitimate claim or engages in unethical business practices, you will find experienced South Carolina attorneys ready to hold them accountable. The Shelton Law Firms represents insured business owners in the Lowcountry or individuals who have had a valid insurance policy in place, suffered a substantial loss; have properly reported the loss to the insurance company, and their claim has been wrongfully denied.

The wrongful denial of an insurance claim can take many shapes. In one case, the insurance company may attempt to deny a claim asserting that the policy was been previously canceled. In this type of case, the burden falls on the insurance company to prove compliance regarding the notice of cancellation. In some cases, insurance adjusters may unreasonably delay the process.

Insurance coverage disputes may involve these types of insurance policies:

  • Homeowner's Insurance

  • Life Insurance Claims

  • Long Term Disability Claims

  • Car Insurance

  • Health Insurance

  • Home Fire Insurance

  • Malpractice Insurance

  • Commercial General Liability Policies

  • Corporate Officers and Directors Policies

Bad Faith Failure to Settle Claim

One commonly litigated insurance issue is “the bad faith failure to settle the claim”. This means the insurance company had the opportunity to settle the claim but fails to do so. By failing to settle, the insurance company is failing to protect the insured from any judgment that may exceed the insurance policy limits. If this failure is actually in bad faith, the insured party can sue the insurance company for breach of contract (and bad faith). If the party is successful, the insured may be entitled to a percentage of the value of the denied claim, plus reasonable attorneys' fees.

Insurance Policies Should Protect You

Shelton Law Firm assists individuals with many different types of insurance dispute claims for the following types of insurance policies:

Homeowner’s Insurance

Homeowners’ policies can cover unexpected disasters such as fires, floods, theft, and vandalism. If you experience an unfortunate fire, theft, or other loss, the insurance company may wrongfully deny your coverage or may fail to pay the full amount of your loss.

Auto Insurance

Owners of their insured vehicles are entitled to receive the appropriate coverage after a car accident. Automobile insurance policies can be very technical concerning laws that govern what an insurer must tell you when applying for a policy; as well as how the insurance company adjusts your claim following an accident.

Business Insurance

Business owners may protect their companies from unknown disasters by purchasing commercial general (or product) liability insurance, coverage for property damage, business interruption, and others. Oftentimes, claims involving businesses result in complicated questions about insurance coverage. This may result in wrongful coverage denials by insurance companies.

Life Insurance

Financially and emotionally, life insurance is very important to the loved ones left behind following an unexpected death. Claims are sometimes denied because of alleged misrepresentations about the health conditions of the insured, or the circumstances of the insured’s death. Other legal issues can also arise in interpreting life insurance policies and to whom benefits may be payable.
